Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Duskwrit platform, website, and services (collectively, the "Service") operated by Duskwrit ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Service Description
Duskwrit is an AI-powered creative writing platform that combines a rich text editor with automatic worldbuilding tools, including entity detection, knowledge graph generation, consistency checking, and AI-assisted prose generation. The Service is designed for novelists, screenwriters, game writers, and other creative professionals.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use this Service. By using the Service, you represent that you meet these requirements.
3. Accounts
You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access. You may not share account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Content Ownership and Licenses
4.1. Your Creative Works: You retain full and exclusive ownership of all manuscripts, stories, novels, worldbuilding content, character descriptions, plot outlines, notes, and any other creative works you write, upload, or create through the Service ("Your Works"). We claim no intellectual property rights over Your Works. Your stories are yours — fully and unconditionally.
4.2. License to Us: By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to process, store, analyze, and transmit Your Works solely for the purpose of providing the Service (including AI-powered features such as entity detection, consistency checking, and writing assistance). This license terminates when you delete Your Works or your account.
4.3. AI-Generated Content: Text, suggestions, entity profiles, brainstorm responses, and other content generated by the Service's AI features in response to Your Works are derivative of your creative input. You own these AI-generated outputs to the extent permitted by applicable law and may use them in your published works without restriction or attribution to Duskwrit.
4.4. No Training on Your Works: We do not use Your Works to train, fine-tune, or improve AI models. Your manuscripts are processed via third-party AI APIs (Anthropic Claude, Google Gemini) solely to provide real-time features. These providers' data usage policies apply to API interactions, and as of the date of this policy, neither Anthropic nor Google uses API inputs for model training.
4.5. Feedback: Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation to you.
Your IP — Plain English Summary
- All content you create using Duskwrit belongs to you. We claim no ownership over your manuscripts, characters, worlds, or any creative work.
- We do not use your writing to train AI models. Your manuscripts are processed via AI APIs solely for real-time features, never for training.
- Content generated with AI assistance (including improved, expanded, or shortened text) is your intellectual property. Use it however you wish — publish, sell, adapt — with no attribution to Duskwrit required.
- You may export all your data at any time, in standard formats, regardless of your plan status. Free or paid, you always have full access to your work.
- Deleting your account removes all your data from our servers within 30 days. No lingering copies, no hidden retention.
5. Acceptable Use
5.1. You agree NOT to use the Service to:
- Upload or create content that infringes any third party's intellectual property rights.
- Generate content that is illegal, threatening, abusive, or promotes violence against specific individuals or groups.
- Generate child sexual abuse material (CSAM) or content sexualizing minors in any form.
- Attempt to reverse-engineer, decompile, or extract the underlying AI models, algorithms, or source code.
- Use automated means to access the Service beyond any provided API (no scraping or unauthorized bots).
- Resell, sublicense, or redistribute the Service or its AI capabilities without written authorization.
- Circumvent usage limits, plan restrictions, or rate limits.
- Interfere with or disrupt the Service or its servers.
- Use the Service to generate bulk content for SEO manipulation, spam, or deceptive purposes.
5.2. Content Moderation: Duskwrit is a creative writing tool. We recognize that fiction explores a wide range of themes, including violence, conflict, and mature subject matter. We do not monitor or moderate the content of your manuscripts. However, we reserve the right to terminate accounts used to generate content that violates applicable law or poses a risk of harm.
5.3. We reserve the right to remove any content and suspend or terminate any account that violates these Terms, at our sole discretion.
6. Subscription Plans and Payment
6.1. The Service offers free and paid subscription plans. Plan details, features, and pricing are described on our pricing page and may be updated from time to time.
6.2. Paid subscriptions are billed in advance on a monthly or annual basis through Stripe, our payment processor. By subscribing, you authorize recurring charges.
6.3. All fees are exclusive of taxes. You are responsible for any applicable taxes.
6.4. You may upgrade, downgrade, or cancel your subscription at any time through your account settings. Upgrades take effect immediately with prorated charges. Downgrades take effect at the end of the current billing period.
6.5. AI generation limits and project limits reset or adjust according to your plan. Unused AI generation capacity does not roll over between billing cycles.
7. Refund Policy
7.1. If you are unsatisfied with the Service, you may request a full refund within 14 days of your initial purchase or any renewal. Refund requests should be submitted to [email protected].
7.2. Refunds are not available for: partial months of service, AI generation credits already consumed, or accounts terminated for Terms violations.
8. Service Availability
8.1. We strive to maintain high availability but do not guarantee uninterrupted or error-free service. The Service is provided on an "as available" basis.
8.2. We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice when practicable.
8.3. AI-powered features depend on third-party API availability (Anthropic, Google). We are not responsible for outages or degraded performance of third-party AI providers.
9. Data Retention and Export
9.1. Your Works are stored for the duration of your account. We encourage regular exports of your work.
9.2. Export: You may export your complete projects at any time in Markdown, DOCX, PDF, or plain text format via the export feature, regardless of your plan status. We will never hold your work hostage.
9.3. Version history: Scene snapshots are retained according to your plan limits (up to 50 per scene). Older snapshots may be automatically pruned.
9.4. Upon account deletion: All associated data — manuscripts, entities, knowledge graphs, chat history, version history, and personal data — is permanently deleted within 30 days.
10. Third-Party Services
The Service integrates with third-party platforms (Google OAuth, GitHub OAuth, Discord OAuth, Stripe, Anthropic API, Google Gemini API). Your use of these integrations is subject to the respective third party's terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
11. Intellectual Property
The Service, including its design, code, AI integration layer, branding, and documentation, is owned by Duskwrit and protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks, logos, or brand assets.
12. Limitation of Liability
12.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUSKWRIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, CREATIVE WORKS, BUSINESS OPPORTUNITIES, OR GOODWILL.
12.2. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12.3. THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE).
12.4. DATA LOSS: While we implement reasonable safeguards, we strongly recommend maintaining local backups of your manuscripts. We are not liable for data loss due to system failures, security breaches, or service discontinuation.
13. Indemnification
You agree to indemnify, defend, and hold harmless Duskwrit and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) Your Works or any content you create; (c) your violation of these Terms; or (d) your violation of any third party's rights.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, CONSISTENT, OR SUITABLE FOR ANY PARTICULAR PURPOSE. AI FEATURES ARE CREATIVE TOOLS, NOT AUTHORITATIVE SOURCES.
15. Termination
15.1. You may terminate your account at any time by contacting us or through account settings. We recommend exporting your work before termination.
15.2. We may terminate or suspend your account at any time for any reason, including violation of these Terms, with or without notice.
15.3. Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our data retention policies.
16. Dispute Resolution
16.1. These Terms are governed by the laws of Canada, without regard to conflict of law principles.
16.2. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the applicable rules, or the courts of competent jurisdiction in Canada.
17. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.
18. General
- If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
- Our failure to enforce any right does not constitute a waiver of that right.
- These Terms constitute the entire agreement between you and Duskwrit regarding the Service.
